In some severe cases, a dangerous dog could cause injuries that require plastic surgery to reach maximum medical improvement.
What Dog Bite Injuries Require Reconstructive Surgery?

Severe injuries sustained in a dog attack may require reconstructive surgery. Here are the most common types of damage that typically lead to intense surgical procedures:

Facial wounds, such as deep lacerations

Tissue loss

Significant muscle damage

Permanent scarring or disfigurement in visible areas, such as the face, hands, or neck

Nerve damage that causes a loss of mobility, requiring reconstructive repair

What Are Common Types of Dog Bite Plastic Surgery?

Plastic surgery can be incredibly expensive, and many victims must bear the costs that insurance companies do not cover. Here are some common surgical procedures for severe injuries caused by dog bites:

Scar revision – This procedure minimizes visible scarring through excision, laser, or grafting

Skin grafts or flaps – A process designed to replace or repair the outer layers of the skin

Microsurgery – Used to restore function or sensation to injured areas

Facial reconstruction – A surgery that can realign bones or tissue after deep bites

Revisions over time – As children grow, they may need multiple surgeries to the affected area

What Are the Medical Costs Associated With Dog Bite Plastic Surgery?

The average cost of a minor scar revision procedure can fall between $3,000 and $5,000. However, a complete reconstruction of an injury could cost $20,000 to over $100,000.

With a successful dog bite settlement, you can recover these costs as economic damages.

What Other Damages Can Bite Victims Seek From Illinois Dog Owners?

Let’s look at the types of legal damages you can include in a dog bite case:

Economic Damages

Lost wages during recovery

Medical expenses, including surgery, anesthesia, emergency room visits, hospital stays, and medication

Future medical bills, such as rehabilitation and physical therapy

Diminished future income

Non-Economic Damages

Emotional distress, such as PTSD, depression, or social anxiety, caused by permanent scarring

Pain and suffering during and after treatment

Disability and disfigurement (recognized as a distinct compensatory damage when visible deformities affect a person’s appearance under 735 ILCS 5/2-1115.2)

Loss of enjoyment of life or self-esteem

Does the Owner’s Knowledge of Their Dog’s Past Behavior Impact Claim Values?

Under the Illinois Animal Control Act (510 ILCS 5/16), the owner’s knowledge of a dog’s behavior is irrelevant due to strict liability. Dog owners are fully liable for legal damages suffered by victims unless the victim provoked the animal or trespassed on private property.

As the plaintiff, you do not have to prove negligence for your dog bite claim. All you must prove is that you were lawfully present on the owner’s property and did not provoke the attack. There must also be evidence that the dog attacked or appeared to attack you and caused personal injuries.

Pursuing compensation from the dog owner’s insurance company is a challenging task. Although you don’t have to prove the dog owner’s negligence due to strict liability laws, it can still be difficult to win your claim.

Taking Proactive Steps to Minimize Scarring After a Dog Bite

A dog bite can be a traumatic event, especially if it causes devastating injuries that could turn into permanent scars. While your physical health is a priority after you are bitten by a dog, you can also take steps to preserve your long-term emotional well-being by minimizing scarring. Learning how to prevent a dog bite from scarring can reduce the risk of your injuries becoming permanent.

No matter the impact of a dog bite, securing compensation from the at-fault party is easier with a professional attorney on your side. Our Chicago dog attack law team specializes in supporting dog bite victims as they seek justice and compensation for their suffering.

The Most Important Step: Seek Immediate Medical Attention

Your top priority after being bitten by a dog is to seek medical attention immediately. The longer you wait to receive a diagnosis, the more likely your injuries are to develop scars. Medical professionals can assess the damage and create a treatment plan that provides the greatest chance of full recovery.

Your doctor can clean the area to prevent infection, which is one of the primary causes of scars. They can also determine if stitches are needed to foster a more effective healing process. If you want your long-term appearance to be unaffected by the injuries, you must seek medical intervention right away.

Additionally, seeking treatment can have a significant impact on your chances of winning a civil claim against the dog owner.

Following Your Doctor’s Aftercare Instructions is Crucial

Following your doctor’s orders is crucial. All their treatment will mean nothing if you ignore their recommendations after your appointment. The care provided in the days and weeks following the bite is essential to minimize scarring.

Keeping the Wound Clean and Moist to Promote Healing

If bacteria come into contact with the affected area, it will increase the chances of infections and scars. Therefore, gently clean the affected area with soap and water. Keep the area covered with a bandage to maintain moisture, and consider using silicone gel sheets to reduce the risk of scarring.

Protecting the Wound as It Heals

It is vital to protect your injury as it heals. Do not pick at the scab, as this will almost guarantee that you will have visible scars. You should also try to avoid strenuous movements that affect the injured area, because this could cause additional tears in the skin or tissue. The more stress the damaged area is put under, the harder it will be for the natural healing process to run its course.

Long-Term Care for a Healing Scar

With proper care, the wound should heal and close. However, there is still a risk that scars will develop. Make sure you care for this area of your skin with sun protection, moisturizer, and even scar gel treatments. Your physician may recommend additional steps for long-term care, so follow their suggestions.

Your Legal Rights: Holding Dog Owners Financially Responsible

As a victim of a dog bite, you have the right to pursue legal action against the at-fault owner. Under the Illinois Animal Control Act (510 ILCS 5/), owners are strictly liable for the compensatory damages caused by their pets attacking other people. Some states exempt owners from liability for a first offense, but this is not the case in Illinois.

Some legal damages you could be eligible for if you have experienced a canine attack include:

Lost income

Medical bills (scar revision treatments, medication, rehabilitation, therapy)

He required emergency medical treatment and will need additional care as he grows. The severity of the injuries, his very young age, and the likelihood of permanent scarring all drove the significant recovery.

$700,000

Emily was bitten on the arm by her neighbor’s dog in an unprovoked attack, suffering serious nerve damage. Facial scars from dog bites can have lifelong physical and mental consequences, including a lasting impact on self-confidence.

Our Chicago dog bite lawyers know what it takes to assess the impact of facial injuries and seek fair compensation for your legal damages while you focus on recovering.

Why Facial Injuries from Dog Bites Are So Severe

Facial injuries from a dog bite are very serious. Often, the damage is extensive to vital facial parts, requiring reconstructive surgery. Additionally, the mental impact is massive because the face is part of our outward appearance, so permanent scars can make us feel self-conscious about how we look.

These types of injuries are especially common among children, primarily due to their smaller stature and proximity to the height of a dog’s mouth. Here are some head and neck injuries that could be sustained during a dog attack:

Lacerations

Puncture wounds

Soft tissue damage

Lost skin

Tissue loss

Broken bones

Life-threatening vascular damage

Eye injuries

Dental injuries

Facial scars

Nerve damage

The Psychological Trauma of Facial Scars

The healing process for physical injuries may be quick for minor attacks, but emotional trauma can last a lifetime. Many victims of dog bites suffer from Post-Traumatic Stress Disorder, anxiety, depression, and thoughts of self-harm.

A victim whose face is affected by permanent scarring after the attack could also struggle with a loss of self-esteem and body confidence. They can withdraw from social interactions to avoid friends and loved ones noticing their appearance.

How We Value a Claim for Facial Disfigurement in Illinois

Disfigurement and scarring can be categorized as non-economic losses in a civil lawsuit. With facial injuries from dogs, the likelihood of permanent alterations to your appearance is high. Therefore, you can seek a settlement for the impact of the dog attack on your mental well-being.

Lawyers from our law firm will consider multiple factors to determine the value of your claim, including mental health professional testimony, medical bills, therapy costs, scar revision expenses, surgery bills, journal entries, and other relevant evidence.

Recovering Full Compensation for Your Dog Bite Injuries

In Illinois, victims can file personal injury claims to recover damages for suffering caused by someone else’s negligence. Common damages that victims may seek after a dog bite attack include:

Economic Damages

Lost wages

Medical expenses (surgical interventions, wound care, cosmetic procedures)

Future care bills

Property damage

Diminished earning capacity

Non-Economic Damages

Emotional distress

Pain and suffering (resulting from injuries)

Loss of enjoyment of life

Punitive Damages

A judge or jury can award punitive damages in cases involving gross negligence or intentional misconduct.

The Advantage for Dog Bite Victims in Illinois

Under the Illinois Animal Control Act (510 ILCS 5/), dog owners are strictly liable for injuries caused by their dogs. As long as you did not provoke the incident or trespass on private property at the time of the incident, liability is automatically assigned to the dog’s owner for dog bite injuries.

The Importance of Immediate Medical Treatment

No matter how minimal your injuries or scars may seem, it is crucial to seek immediate medical attention after a dog bite. This will ensure that you receive a proper diagnosis and a tailored treatment plan to address the damage to your skin. If you avoid appointments early on, the risk of permanent scars will increase.

Additionally, delaying medical intervention could undermine your claim, as the defendant or insurance company could state that you are exaggerating the dog bite’s impact for a higher settlement. You should also consider taking legal action immediately, as Illinois has a two-year statute of limitations for personal injury claims (735 ILCS 5/13-202).

A dog bite, especially from a powerful breed like a pit bull or German Shepherd, can lead to lifelong suffering. Disfigurement in dog bite cases is often the most permanent and devastating outcome of the attack, not to mention the emotional trauma and the impact on your physical capabilities.

Illinois laws recognize the substantial harm that disfigurement from a dog attack can have on your life. Fortunately, there is a legal path for victims to seek significant compensation by holding the dog owner accountable for their negligence.

Our dog bite injury law firm in Chicago can help you fight for justice and obtain the maximum settlement after suffering from scarring and disfigurement after the attack.

Common Types of Disfigurement from Dog Bite Injuries

A disfigurement is a type of injury that permanently affects the physical makeup or appearance of the victim. The severity of these injuries can lead to physical challenges and psychological distress.

Here are some of the most common disfigurement injuries that victims of dog bites suffer:

Permanent scars, especially on the face, neck, arms, or legs

Loss of body parts, such as fingers, noses, ears, or other appendages

Nerve or muscle damage that affects mobility or appearance

Facial injuries

Even smaller dog bite injuries can lead to permanent disfigurement, so consult a top dog bite attorney to assess your legal damages and calculate a fair settlement.

The Deep Psychological Toll of Dog Bite Scars

Visible scarring and disfigurement can also lead to more “invisible wounds.” The impact of a severe injury, especially after multiple reconstructive surgeries, can affect you emotionally. Survivors of this type of trauma often face Post-Traumatic Stress Disorder, depression, social anxiety, and a loss of self-confidence.

In dog bite cases, this psychological harm can be claimed in your settlement as a non-economic loss, driving the value of your case up.

Key Factors That Determine the Value of a Disfigurement Claim

Although many physical wounds heal over time, disfiguring injuries are often permanent. The impact of the dog attack will determine how much compensation you can earn in the settlement.

Here are several factors that will influence your payout:

The severity of the personal injury

Medical bills from your treatment options, including surgery, medication, emergency care, scar treatment, rehabilitation, and physical therapy

Future costs of medical care

Emotional distress caused by facial scar tissue or other injuries

Available evidence from the accident scene

Insurance policy limits for the defendant

Recovering Full Compensation for Your Dog Bite Injuries

Personal injury claims typically involve two types of legal damages: economic and non-economic. Let’s take a closer look at how specific losses can increase your settlement.

Economic Damages

These losses are related to the direct financial implications of the dog bite attack. Your dog bite attorney will help you understand the full scope of economic damages in your claim.

Lost wages

Medical bills (plastic surgery, scar revision treatment, skin grafts, therapy)

Future medical expenses (ongoing rehabilitation and psychological counseling)

Property damage

Loss of earning capacity

Non-Economic Damages

These losses are based on the non-financial and human costs associated with your scarring and disfigurement. Dog bite scars are recognized as a significant element in non-economic losses in Illinois. Here are some of the most common non-economic losses that can exist alongside permanent disfigurement:

Emotional trauma (PTSD, anxiety, depression, fear of dogs)

Pain and suffering

Loss of enjoyment of life

How Illinois Law Protects Dog Bite Victims

Dog bite victims in Illinois can take advantage of the Animal Control Act (510 ILCS 5/) to pursue compensation.

Under this statute, dog owners can be held strictly liable for injuries caused by their pets. The only defenses relevant to these claims are provocation and trespassing. If you can prove that you did not provoke the dog bite and that you were not trespassing at the time, then strict liability will ensure the owner is accountable for your legal damages.

Some states operate with a “one-bite rule.” This standard exempts owners from liability for first offenses, especially if the dog has not displayed aggressive behavior in the past. Essentially, the owner is not liable for the first time their dog bites someone.

You also have time to consider legal action after a dog bite incident. Under the statute of limitations for personal injuries (735 ILCS 5/13-202), the injured party has two years from the date of the incident or the date they discover their injuries to pursue legal action against the at-fault party.

How an Attorney Fights for Your Full Compensation

Our law firm can play a crucial role in supporting your pursuit of a fair settlement. You have the right to seek justice for the dog bite scars that are affecting your physical, emotional, and financial health.

$375,000

Four-year-old Caleb was mauled by a pit bull, leaving lasting facial scars after surgery. His age and the likelihood of future procedures impacted the case value.

$165,454

Postal worker Robert was attacked by a Boxer while delivering mail, causing arm injuries and nerve damage. The effect on his ability to work raised the case value.

Medical Costs of a Dog Bite Injury

Every year, dog bites lead to significant medical costs in Illinois for injured victims. In many cases, these medical expenses in dog bite cases are paid out of homeowner’s insurance policies from the at-fault parties.

According to the Insurance Information Institute, dog bite claims totaled $47.5 million in the state in 2021. The average cost of a claim was over $52,000.

If you are the victim of a dog bite in Illinois, shouldering these medical bills after a traumatic attack can feel overwhelming. Fortunately, state laws provide you with several avenues for handling this financial burden and holding the negligent dog owner accountable for your suffering.

Use Your Own Health Insurance for Immediate Bills

Since Illinois is a strict liability state, ultimate responsibility for your legal damages will fall on the dog owner’s insurance company. However, the initial medical costs you face cannot be covered by the defendant until a claim is resolved. Therefore, you must submit your initial medical bills to your own insurance carrier.

This ensures that the doctors and medical entities receive payments on time and the bills do not proceed to collections.

The Dog Owner’s Legal Responsibility for All Medical Treatment

The reason Illinois has strict liability laws is due to the Animal Control Act (510 ILCS 5/). Under this statute, the dog owner is legally responsible for the full cost of all reasonable and necessary medical care that results from the dog bite injuries.

Rather than having to prove that the dog owner is negligent, this is automatically assumed to be the case. However, you must prove that you did not provoke the dog, nor did you trespass on the dog owner’s property at the time of the incident. If you can confirm this, medical bills after a dog bite will be the owner’s responsibility.

Proving that you are innocent of provocation and that you suffered legal damages from the dog bite can be a complex process. Our law firm has years of experience holding dog owners accountable and assessing the full damages of dog bite plaintiffs.

Where Does the Final Payment Come From?

At the end of a dog bite lawsuit, the settlement is typically paid by the dog owner’s homeowner’s insurance policy. In some cases, the payout may also come from their personal assets. A large portion of your settlement will likely go to your insurance carrier for the costs they incurred for your initial medical expenses.

The Dog Owner’s Insurance Policy

In most cases, payment for medical bills after a dog bite will be covered by a homeowner’s insurance policy. This type of claim falls under the liability portion of most policies. It could also come from a renter’s insurance policy for the same reason.

It is important to note that some insurance policies do not cover injuries caused by certain breeds. Breeds that are more likely to cause dog bite injuries, such as pit bulls or German Shepherds, may be excluded from the liability portion of the dog owner’s insurance coverage. In this case, the medical bills after a dog attack may be covered by the owner’s assets.

What If the Owner is Uninsured?

If the dog owner is uninsured, it does not necessarily mean you cannot seek compensation for medical expenses. Instead, you may have to file a personal injury lawsuit. This legal action will allow you to recover a settlement from the dog owner’s personal assets rather than from an insurance company.

Suppose assets are required to pay off a dog bite settlement, either due to the dog owner being uninsured or not having enough coverage for the total value. In that case, the following items may be used to finalize the payout:

Real estate properties

Bank accounts

Investments (stocks and bonds)

Wages (called wage garnishment)

Valuable possessions (boats, cars, and other property)

How Your Health Insurance Is Reimbursed

In personal injury claims, there is a legal concept called a medical lien. A medical lien is typically used to reimburse a provider or insurance company out of a personal injury settlement.

For a dog bite incident, let’s look at an example of how this process would work. First, you would seek treatment for the injuries suffered from the dog attack. The provider would then bill your insurance carrier for services rendered once you file an insurance claim. You would be responsible for covering any deductibles and copays.

However, the insurance company would then place a medical lien on your potential settlement. If your claim is successful against the dog owner, then the insurance company or healthcare provider would receive the amount owed before the rest of the settlement goes to you.

This is why documenting your dog bite injuries, treatment, and rehabilitation costs is crucial. You need an accurate record of these medical expenses to estimate how much will be taken out of your settlement for the medical lien.

What Medical Costs Are Covered in Dog Bite Claims?

Dog bite victims can recover compensation for all medical costs that are reasonably associated with their injuries. Medical records, test results, and doctor testimony will play a crucial role in proving these damages to secure a favorable settlement from the dog owner.

Here are some common medical treatment costs that may be included in your claim:

Emergency room care

Reconstructive surgery

Physical therapy

Medication for pain management

Rehabilitation

Medical devices

Psychological trauma treatment

Diagnostic imaging

Vaccinations

Hospital stays

Insurance coverage copays and deductibles

If a dog bite occurs, it is important to consider taking legal action against the dog owner swiftly. In Illinois, the statute of limitations for personal injury claims gives dog bite victims two years from the date of the incident or the date of discovery of their injuries to pursue compensation (735 ILCS 5/13-202).

Some exceptions may extend that deadline, such as a minor victim of a dog bite or a defendant who leaves the state.

The Invisible Wounds of a Dog Attack

Not all injuries caused by a dog bite are visible. In fact, the incident’s longest-lasting impact may be on the victim’s emotional health. When you get viciously attacked by a dog, no matter how severe the physical injuries are, you could live with the psychological trauma for a long time.

Pursuing compensation for both physical and emotional pain and suffering can lead to a larger settlement for the dog bite victim.

Fortunately, Illinois law recognizes the impact that emotional distress can have on a person’s life after a significant injury. Our dog bite injury attorneys can help you maximize compensation for various economic and non-economic damages after a dog bite attack, including emotional distress.

What Is Legally Considered “Emotional Distress”?

Emotional distress can cover a wide range of emotional and mental health challenges after a traumatic event. Here are some of the most common examples of this non-economic loss:

Post-Traumatic Stress Disorder (PTSD)

Anxiety

Depression

Sleep disturbances

Withdrawal from social activities

Unexplained fatigue

Suicidal thoughts

Unusual anger or irritability

Intense fear of dogs

How Do We Prove Emotional Damages in Court?

Proving emotional trauma requires specialized evidence. While it is easy to demonstrate medical expenses and lost wages as losses in a legal claim, the effect of psychological injuries is harder to prove.

Strong documentation is required to prove that you are suffering emotionally as a dog bite victim. In most cases, this will require expert testimony from psychologists, therapists, or other emotional health professionals. Our attorneys know how to prove this type of damage in your personal injury lawsuit.

Types of evidence that could support your emotional distress claim include:

Journal entries

Mental health professional diagnoses

Treatment plans

Medical bills

Manifestation of physical symptoms

Correspondence that demonstrates your emotional damages

Calculating Compensation for Emotional Distress and Its Impact on Daily Life

Attaching a monetary value to emotional damages can be confusing, especially for first-time plaintiffs. How do you determine a number to demand for a settlement when the suffering is intangible?

Various methods are used to calculate the value of non-economic damages, including:

Multiplier method – The amount of economic damages will be multiplied by a factor based on the impact on your daily life

Per diem method – A daily value is determined for the harm you have suffered, which is then multiplied by the number of days you have suffered

Your Right to Full Compensation Under Illinois Law

According to the Animal Control Act (510 ILCS 5/), dog owners in Illinois are strictly liable for legal damages caused by their pets. This means that unless you provoked the dog or were trespassing at the time of the incident, the owner must cover your losses resulting from the injuries.

In some states, the “one-bite rule” protects owners from liability for a first offense if their dog has not displayed aggressive behavior in the past. In Illinois, the owner is liable for all unprovoked attacks regardless of the animal’s history.

Therefore, you can recover a settlement for Post-Traumatic Stress Disorder, medical bills, physical scars, pain and suffering, and other losses if you did not provoke the attack.

How Our Firm Fights for the Compensation You Deserve

When you seek compensation for lost wages, medical expenses, and emotional trauma after a dog attack, you need an experienced law firm on your side. Our Chicago dog bite injury team has recovered multiple settlements for many victims of dog attacks, including:

What You Need to Do in the Immediate Aftermath of a Dog Bite

People who are bitten by dogs are often in shock in the immediate aftermath of their ordeals. It can be a scary and painful experience, especially if you have suffered significant wounds. It is essential to stay calm and apply pressure to the wound (with a clean cloth if available) if you are bleeding. Additionally, if the attack is over, avoid direct eye contact with the dog, as this could incite another attack.

To prioritize your health and financial future, follow the steps outlined below.

Seek Medical Attention Immediately and Watch for Signs of Infection

The first and most important step is to seek medical attention immediately. A prompt diagnosis is crucial to preserve your well-being, as even a small dog bite can lead to infection or nerve damage.

First, consider visiting an emergency room or urgent care for severe injuries. You should also schedule a visit to a licensed physician who can perform medical tests to determine the extent of your injuries.

Next, you must document your injuries, diagnosis, and treatment plan. Take photos of the physical damage on your body from the dog attack. Keep all medical records associated with your treatment. Track your medical expenses from surgery, rehabilitation, and other treatment strategies. Timely medical attention will support your medical needs and enhance your legal credibility in the event of a future civil claim.

What Are the Risks of Infection Associated With Dog Bites?

Dog bites can easily become infected. A dog’s mouth harbors a significant amount of bacteria and germs, and these substances, when they penetrate the skin layer, can pose a substantial health risk. Some of the most common bacterial strains in these scenarios include Pasteurella, Staphylococcus aureus, and Capnocytophaga canimorsus.

This is why seeking medical attention is crucial after being bitten or attacked by a dog. You may need professional wound cleaning, antibiotics, Tetanus shots, and Rabies shots in some cases.

In the days following your dog bite incident, be aware of the signs of infection. Redness, swelling, warmth, new bleeding, the presence of pus, or a fever could indicate that the wound has become infected. At that point, you should visit your doctor immediately to pursue additional medical treatment.

Report the Dog Bite

Your next course of action should be to report the dog bite wound to the relevant entities. Under state law 510 ILCS 5/12, all dog bites must be reported to a licensed veterinarian within 24 hours of the attack. You should also contact the local Animal Control agency or police department to create an official report of the incident.

For residents of Chicago, you should contact the Chicago Department of Animal Care and Control to report a dog bite. Once a veterinarian is notified of the incident, a legal process will ensue. The dog will be placed under a 10-day confinement for observation to monitor for Rabies or other infectious diseases.

Reporting a dog bite to these entities is important to initiate medical care processes and to prepare for a potential future lawsuit against the dog owner.

Gather and Preserve Evidence

The next few steps are related to your legal options after a dog bite attack in Illinois. Evidence will be necessary to prove that you were not trespassing on private property or provoking the dog when the bite occurred.

Take photographs of the scene, including any wounds you suffered and the dog. If there are nearby signs indicating leash laws, take a picture of them. You should also search for hazards that may have contributed to the dog’s escape, such as a broken gate or an insufficient fence.

Next, speak with passersby who witnessed the attack and record their statements. You should also exchange contact details with the dog owner once you have identified them. If the dog owner is unknown, witnesses and Animal Control can help identify the owner.

Preserve physical evidence from the attack, such as torn clothing or destroyed property. It is possible to request prior complaints or records of the dog in question from the local animal control or health department.

Understand Your Rights Under the Illinois Animal Control Act

The Illinois Animal Control Act (510 ILCS 5/16) establishes strict liability for pet owners when dogs cause wounds. Rather than proving negligence, as is the case in most personal injury scenarios, victims must only prove that the dog attacked them, that they were not trespassing, and that they didn’t provoke the dog.

The court will also consider whether the dog was leashed or has an aggressive history, which can influence the civil and criminal penalties for the owner.

What Damages Can Dog Bite Victims Recover in Civil Cases Against Dog Owners?

Common legal damages in dog bite claims include:

Lost wages

Medical bills (surgery, rehabilitation, therapy)

The pet owner could face criminal charges if the dog had a history of aggression or if the person violated confinement rules. A vet’s report could lead to further investigation or hearings regarding the animal’s classification as a vicious dog.

In Illinois, victims are not powerless: state law gives dog bite victims a clear legal path to hold the animal’s owner responsible and recover compensation for the medical treatment, reconstructive surgery, and emotional trauma caused by disfigurement.

The Importance of Immediate Medical Treatment for Dog Bite Wounds

If you’ve been bitten by a dog, your first priority should be immediate medical attention. Early intervention cleans and stabilizes the wounds, and it can prevent infections, reduce the likelihood of nerve damage, and help prevent uncontrolled scar formation that can lead to disfigurement.

Early treatment also supports the healing process of dog bite wounds, easing pain and laying the groundwork for any future reconstructive surgery or scar treatment options.

Why Early Treatment is Critical for Both Health and a Legal Claim

Following your doctor’s treatment plan is just as important as the initial medical care. Consistent early adherence to prescribed care helps wounds heal more completely and reduces the risk of long-term problems such as scars, restricted movement, or emotional trauma.

This ongoing care also creates a clear medical history documenting the wound site, scar size, your healing progress, and the need for future plastic surgery or other procedures.

When pursuing a personal injury claim against the dog owner or their insurance company, these records are essential to prove the full extent of your injuries and secure maximum compensation for the lasting reminder of the attack.

Explaining the Dog Bite Scar Formation Process

After a dog bite, the healing process begins immediately, but the damage from an attack is usually far more severe than a simple cut. Puncture wounds, jagged edges, and crushing damage from dog’s teeth tear through multiple layers of skin and underlying tissue, creating thicker, more irregular scar tissue.

As the wound repairs itself, excess collagen can form scars like keloid or hypertrophic scars, especially if infection or delayed care occurs. Many victims end up with permanent scars that may require surgery, lasers, or other treatments to improve appearance and emotional well-being.

Common Types of Permanent Scars from Dog Bites

Because dog’s teeth puncture, tear, crush, and inflict deep wounds, the type of scar left varies depending on the severity of the attack, the healing process, and the individual’s skin type. Understanding these differences is important for both treatment and legal claims.

Keloid Scars

Keloids are thick, raised scars that grow beyond the original wound’s boundaries. They often develop after severe puncture wounds or jagged edges and can be painful, itchy, and noticeably darker or thicker than the surrounding skin. This type of scar tissue may require laser treatments, corrective surgery, or other treatment options to reduce its appearance.

Hypertrophic Scars

Hypertrophic scars are also raised, but unlike keloids, they remain within the original wound area. They tend to be red and rigid, sometimes compromising movement around the affected area.

With early medical treatment and cosmetic surgery or reconstructive surgery, many hypertrophic scars can improve over time, but they still represent a lasting reminder of the attack and may justify compensation for emotional and physical pain.

The Deep Psychological Toll of Dog Bite Scars

For many victims, dog bite scars are as emotionally devastating as the physical wounds. The lasting reminder of scars can trigger anxiety, depression, and even PTSD, especially when highly visible.

Changes in appearance, movement, and ongoing trauma can erode self-esteem and emotional well-being, disrupting daily life, relationships, and careers, all valid factors in a personal injury claim.

Medical and Cosmetic Treatment Options Available

Victims of dog bites have multiple options to improve the appearance and function of dog bite scars, reduce scarring, and support emotional healing:

Plastic surgery or reconstructive procedures to repair deep tissue damage and improve appearance of disfiguring scars

Laser therapy to flatten scars such as hypertrophic and keloid scars

Steroid injections to reduce inflammation and soften scar tissue

Skin grafting to restore damaged skin and improve mobility in the affected area

Microneedling or dermabrasion to smooth the skin and minimize irregular texture

Topical silicone gels or pressure dressings to help diminish scars and improve the healing process

Mental health counseling to address emotional distress, PTSD, and loss of self-esteem related to permanent disfigurement

These treatment options can be costly, but in Illinois, victims can pursue compensation from the animal’s owner or their insurance company to cover both medical care and emotional hurt.

How Illinois Law Holds Dog Owners Accountable for Bite Injuries

Illinois takes dog bites seriously and enforces one of the nation’s strongest laws to protect dog bite victims. Under the Illinois Animal Control Act (510 ILCS 5/), the state follows a strict liability rule.

This means that if you’ve been bitten by a dog, the dog owner is financially responsible for your medical care, surgeries, and other treatment options, even if their dog had never been aggressive before. Victims do not need to prove negligence, they simply need to show they were lawfully present and did not provoke the dog.

Chicago adds another layer of protection under the Municipal Code – Chapter 7-12: Animal Care and Control, which regulates responsible dog ownership and penalties for violations within city limits.

Victims also have a limited time to act: under 735 ILCS 5/13-202 of Illinois’ statute of limitations for personal injury, you generally have two years from the date of the attack to file a lawsuit against the dog owner. Acting promptly protects your legal rights and ensures critical medical records and evidence are preserved.

“Disfigurement”: A Specific Category of Damages in Illinois

In addition to recovering medical bills, lost income, and therapy costs, Illinois law recognizes “disfigurement” as its own category of damages. This means dog attack victims can seek compensation specifically for the emotional trauma, loss of self-esteem, and permanent disfigurement caused by dog bite scars.

These non-economic damages reflect the lifelong harm of severe scars, damaged nerves, and compromised movement, helping survivors rebuild both their appearance and their emotional well-being after a dog bite.

Permanent injuries from dog attacks can change lives forever. Beyond wounds and fractured bones, victims suffer scarring, nerve damage, and lasting emotional trauma like PTSD and intense phobias, often requiring ongoing medical care, reconstructive procedures, and physical therapy.

At Dog Bite Injury Lawyer, we know how devastating these cases are. Illinois law holds pet owners strictly liable for unprovoked attacks, allowing victims to seek fair compensation for medical expenses, lost wages, future care, and emotional harm. Our Chicago dog bite injury attorneys fight to hold negligent owners accountable and secure the resources our clients need for a lifetime of challenges.

Common Injuries That Often Result in Permanent Damage

Some dog attack injuries heal quickly, but others cause lasting harm. Deep bites, tearing lacerations, and crushing force can damage muscle tissue, blood vessels, and nerves. Without prompt medical attention, these wounds may lead to severe complications, ongoing pain, and permanent damage that disrupts everyday life.

Deep Puncture Wounds and Chronic Infections

Deep puncture wounds are one of the most dangerous types of dog bite injuries. Because a dog’s teeth can penetrate multiple layers of tissue, bacteria are introduced deep beneath the skin, where it’s harder to clean and treat. This greatly increases the risk of persistent or recurring infections.

Chronic infections can destroy tissue over time, reduce circulation, and leave scars or disfigurement. In severe cases, dog bite victims may need long-term antibiotics, scar revision, or even skin grafts to address permanent tissue damage.

Severe Lacerations and Muscle Tears

Severe bites often create jagged lacerations and tearing wounds that rip through muscle tissue, tendons, and ligaments. These deep injuries can lead to a permanent loss of strength, stability, and function in the affected area.

Even with reconstructive surgery and physical therapy, many dog bite victims experience chronic pain, restricted movement, or weakness that affects their ability to perform everyday activities. This kind of significant damage can also lead to disfigurement and the need for repeated medical treatment over a lifetime.

The Long-Term Physical Effects of Severe Dog Bite Injuries

Severe dog attacks often leave lasting physical injuries, not just temporary wounds. Many victims face permanent scars, damaged nerves, and orthopedic issues that affect appearance, movement, and quality of life. Even with medical treatment, restorative procedures, and physiotherapy, these injuries can cause permanent damage and chronic pain that reshapes the future.

Permanent Scarring and Disfigurement

Dog bite scars are often severe and jagged, especially when the attack involves the face, neck, or hands. These visible injuries can be among the most devastating aspects of a dog attack, causing both physical and emotional harm.

Many victims require multiple, costly surgeries to improve their appearance and function. Despite these efforts, complete restoration is rarely possible, and permanent disfigurement and scarring can remain for life, affecting self-esteem and everyday activities.

Permanent Nerve Damage

A dog’s sharp teeth can sever, crush, or stretch nerves beneath the skin. This damage may lead to chronic pain conditions such as Complex Regional Pain Syndrome (CRPS), permanent numbness, loss of sensation, or a partial or total loss of motor control in a limb or facial area.

Nerve injuries can also impair blood flow and healing, compounding the medical complications victims face. These long-lasting effects often require chronic pain management, physiotherapy, and in some cases, lifelong medications.

Broken Bones and Lasting Joint Damage

The force of a powerful bite, or being knocked to the ground during an attack, can break bones or damage joints. Even after fractures heal, victims develop permanent arthritis, chronic pain, and reduced mobility in the affected area.

Displaced fractures, shattered joints, or repeated restorative procedures can also lead to long-term instability and limited range of motion, restricting work, hobbies, and other daily activities.

The Enduring Psychological Scars: Emotional Trauma

Permanent dog attack injuries don’t consist of only physical trauma. Most victims suffer deep psychological trauma that can be as disabling as visible wounds. Even after treatment, the emotional toll of pain and suffering, disfigurement, and scarring can persist for life, disrupting relationships, work, and daily activities.

Post-Traumatic Stress Disorder (PTSD)

PTSD is one of the most common diagnoses after a severe dog attack. Victims may suffer from flashbacks, nightmares, and severe anxiety whenever they encounter dogs or even think about the attack. These symptoms can disrupt sleep, concentration, and personal relationships.

Children are especially vulnerable, and without proper precautions and early mental health intervention, they may carry this trauma into adulthood. Lifelong therapy and medications are often necessary to manage the ongoing pain of PTSD.

Lasting Emotional Distress and Phobias

Many victims develop an intense, permanent fear of dogs known as cynophobia following an attack. This phobia can make it difficult to go for walks, visit friends, or feel safe in public spaces. In addition to this intense fear, dog attack survivors often experience social anxiety, depression, or emotional withdrawal caused by scars or physical limitations.

These emotional injuries can significantly affect self-esteem and quality of life, requiring long-term counseling, support groups, or psychiatric care to regain a sense of security and control.

Your Right to Compensation Under Illinois Law

Illinois gives dog bite victims strong legal protections. Under the Illinois Animal Control Act (510 ILCS 5/), dog owners are strictly liable for unprovoked attacks, so victims don’t have to prove negligence or a history of aggression, only that they were lawfully present.

This strict liability makes it easier for victims with serious injuries to recover fair compensation for medical expenses, lost wages, future care, and emotional harm. Acting quickly to gather evidence and working with an experienced dog bite lawyer helps secure the resources needed for a lifetime of challenges.

Calculating Damages for a Lifetime of Care in Dog Bite Cases

When a dog attack causes serious injuries, the financial impact lasts far beyond the first medical bills. Many victims need lifelong care and expenses that must be included in any legal action. A fair settlement should cover both past costs and future support.

Typical damages include:

Future Surgeries – Reconstructive or plastic surgery.

Ongoing Physical Therapy – Long-term rehab to restore strength and mobility.

Medications and Pain Management – Lifelong treatments for damaged nerves or PTSD.

Home or Vehicle Modifications – Adaptive equipment for lasting physical limits.

Psychological Counseling – Ongoing therapy for emotional distress or fear of dogs.

Lost Future Income – Compensation for reduced earning capacity.

Working with an experienced dog bite lawyer and medical experts helps ensure these long-term needs are fully documented, leading to a fair settlement that reflects the true damage and emotional toll.

“Can a dog bite break a bone?” is an unequivocal yes. Many dog bite victims suffer broken bones, especially children or those who have more fragile bones.

A dog’s powerful jaws, combined with the aggression of the attack and the victim’s attempts to escape, can lead to deep wounds and compound fractures. These fractures often require surgery and physical therapy to heal.

If you have open wounds or broken bones caused by dog bites, seek medical attention immediately, then contact us for a free legal consultation.

How Dog Bites Lead to Severe Bone Fractures

Dog bite bone fractures occur due to two situations, depending on how the bite occurred and the victim’s actions after the attack.

Direct Trauma from the Bite Itself

The average bite force of a large dog is around 320 pounds per square inch (psi), which is roughly 1,420 newtons per square inch (N/in²). The human femur, the strongest bone in the body, fractures at around 4,000 newtons of force. In other words, if a dog’s bite of 320 PSI were applied over just three square inches of surface area, it would generate about 4,270 newtons. This is enough to crush a femur.

The above example uses an adult human femur; however, around 50% of all dog bites occur to children, who have smaller bones and a reduced ability to defend themselves.

Many dog bite injuries are to the face and hands, which have smaller and more delicate bones. Reports estimate that around 5% of dog bites involve facial bone fractures, including skull fractures. In adults, fractures occur most often in the hands as the person attempts to push the animal away or defend themselves.

Given how small these bones are, the average dog’s bite is more than enough to crush bones.

Indirect Trauma from Falls During an Attack

Another common cause of serious injuries in dog bite incidents is when the animal lunges or jumps on the person, such as during rough play with a large, excitable dog. Even if the dog did not mean to attack, a sudden fall onto a hard surface can break a hip, wrist, or arm bone.

In severe cases, such as if multiple dogs are attacking the victim, they may attempt to flee and fall, resulting in both broken bones and other injuries.

Common Types of Fractures Seen in Dog Bite Cases

Multiple types of serious fractures occur in dog attacks, which often require physical therapy and long recovery times. Some of the most common traumatic injuries that professionals see include the following.

Comminuted Fractures: These crush injuries occur when the bone breaks into multiple pieces. Recovery times for these serious injuries can take up to a year or more, which takes a significant financial toll on the victim.

Avulsion Fractures: An avulsion fracture occurs when soft tissue, like a ligament or tendon, pulls away a chip of bone. Not only is this painful, but it can also result in nerve damage.

Open (Compound) Fractures: One of the most severe injuries that can result from a dog bite is a compound fracture, where the bone breaks through the skin. The victim will need immediate medical care to stop bleeding, prevent infection, and repair the bone.

Where Do These Dog Bite Injuries Typically Occur?

Common broken bones from by a dog bite include:

Fingers

Wrists

Legs

Hips

Collar bones

Facial bones

Skulls

The Medical Treatment and Recovery Process for Injuries Caused by Dog Bites

Broken bones from an animal bite cause severe pain and high medical expenses. Some victims take months to recover, often necessitating surgery and physical therapy.

Immediate and Emergency Care

A dog bite victim must immediately go to the emergency room for proper treatment. This process can include taking X-rays to diagnose the type of fracture, setting the bone, and applying a cast or splint. Victims may also receive antibiotics and vaccines.

Surgical Intervention and Long-Term Rehabilitation

For more severe fractures, the victim may need surgery to stabilize the bone. This can include installing plates, screws, or rods to hold the bone together and ensure that it realigns. Additionally, the victim may need rehabilitation to regain their mobility and strength.

Your Legal Rights When Bitten by a Dog in Illinois

The Illinois Animal Control Act makes dog owners strictly liable for any injuries caused by their animal (510 ILCS 5/). Victims are entitled to financial recovery for both economic and non-economic losses associated with the dog bite.

How Strict Liability Helps Victims with Broken Bones

Strict liability means that the dog owner is fully liable for any injury caused by the dog. The victim does not need to prove that the owner was negligent. Rather, all the victim needs to prove is that the attack was unprovoked.

The Animal Control Act only releases owners from strict liability in very specific cases, such as if the animal was in pain, guarding their owner, acting in self-defense, or guarding puppies (510 ILCS 5/). However, the owner has to prove this, not the victim.

This was further affirmed in the appellate case of Scollard v. Williams. In this case, the victim was bitten by a Husky they had been attempting to rescue. The court determined that the defendant could not use the assumption of risk as a defense for an animal attack and that merely being near an animal is insufficient to establish a defense for provocation.

Seeking Full Compensation for Broken Bones Caused by Dog Attacks

Our dog bite lawyers will negotiate with the liable parties for fair compensation, which includes both economic and non-economic damages. Through our expertise, we can accurately evaluate your damages and ensure that you receive everything to which you are entitled under the law.

Economic Damages

You can recover damages for all medical care associated with your injury. This can include emergency room visits, surgery, orthopedic consultations, reconstructive surgery, and rehabilitation costs. Medical costs can also include the cost of psychiatric medication or therapy to overcome Post-Traumatic Stress Disorder.

Lost wages are another significant factor in your damages. Your doctor will determine how much time you need to take off work or what duties you can perform during your recovery process. If you have to accept a lower-paying job because of your injuries, you can also receive lost income damages.

Non-Economic Damages

Dog bite incidents can cause significant pain as well as severe emotional distress. Your financial compensation can also include these elements.

Our team can calculate your pain and suffering damages in multiple ways. One of these is the injury multiplier, which assesses how severe your injuries are and how much they will impact your life. Your economic damages are multiplied by a denominator based on the overall severity.

For example, if you broke multiple bones in your leg and were unable to walk for a year, this may be assigned a 2. All your hard expenses, such as emergency room visits and time off work, would then be multiplied by 2.

Another option is to use the per diem method. In consultation with medical professionals, we assess the duration of your injury and then multiply the number of days by a set amount per day.

To ensure that we can negotiate for fair compensation, keep track of your symptoms, the limitations imposed by the broken bone, and your pain levels each day.

What if I Was Knocked Down But Not Actually Bitten?

The Illinois Animal Control Act makes owners liable for any injuries, not just bite wounds. The law defines physical injuries as “the impairment of physical condition,” which includes broken bones or soft tissue injuries (510 ILCS 5/2.18a).

As such, you can sue for broken bones even if you were not bitten by a dog, such as falling over while running away or being knocked over.

Common Injuries Sustained After a Dog Attack

When considering the consequences of a dog attack, your primary concern may be the risk of dog bites. However, other types of injuries can occur because of an aggressive dog, even if the animal never makes contact with you. Many people suffer from dog attack fall injuries more often than injuries from being bitten.

Often, these cases occur because the person is trying to escape an aggressive dog, causing them to fall. Some injuries you may sustain in this type of scenario could include broken bones, muscle sprains, soft-tissue injuries, or even head injuries.

Under Illinois law, dog owners can still be held liable for fall injuries associated with escaping a dog attack. This means you can file a legal claim and pursue compensation for legal damages, even if the dog never bit you during the escape.

Illinois Law Covers All Injuries Caused by a Dog, Not Just Bites

The language of the Illinois Animal Control Act is extremely important if you are hurt during a dog attack, but not necessarily because of a bite. Under state law 510 ILCS 5/16, a dog owner is responsible for paying the victim’s damages when their animal “attacks, attempts to attack, or otherwise injures” a person.

This means the circumstances surrounding your fall are very important. The presence of dog bite marks is typically enough evidence to establish liability with dog owners. However, fall injuries could occur anywhere and are not always related to a dog attack. If you can prove that the dog was attempting to attack you or managed to knock you over, then you could still seek compensation after the accident.

You will still need to gather evidence to prove the harm you suffered was a direct result of the dog attack and the owner’s negligence. Fortunately, the language of this Illinois statute gives you more flexibility in establishing liability.

As an example, a dog could get off its leash and run toward you. As you attempt to get away, you end up tripping on the edge of the sidewalk, causing a broken wrist. With sufficient evidence of the accident, you could recover fair compensation for your suffering.

When an Owner May Not Be Liable for a Fall

Not all injuries caused by dog bites or falls are the owner’s fault. Although Illinois is a strict liability state, making it easier to hold owners accountable for these incidents, some exceptions could mean the injured person is more at fault.

Here are the two most common defenses used by owners and insurance companies in dog attack claims:

Provocation – The injured person provoked the dog attack by taunting, tormenting, or abusing the dog before the incident occurred

Trespassing – If you are unlawfully on someone else’s property and you get injured by a dog, establishing liability with the owner is unlikely

Whether you suffered fractures, strains, or severe back injuries, the dog’s owner will not be liable if you were provoking or trespassing on their property.

Compensation for Fall Injuries Caused by Dog Bites and Attacks

If you are injured by a fall during a dog attack, you could suffer significant physical, emotional, and financial consequences. A successful claim will allow you to recover compensation to address some of these losses. In most cases, this settlement will come from the owner’s homeowner’s insurance policy.

Economic Damages

Lost wages – If you are forced out of work, the settlement can cover lost income

Past and future medical care expenses – Medical costs associated with treatment can also be recovered, including emergency care, surgery, medication, rehabilitation, and therapy

Diminished earning capacity – If the injuries from the accident prevent you from finding employment in the future, you can seek compensation for lost future income

Non-Economic Damages

Emotional harm – Severe injuries caused by a dog could lead to anxiety, depression, Post-Traumatic Stress Disorder, and other types of psychological trauma

Pain and suffering – After your fall, your injuries could cause significant physical pain

Loss of enjoyment of life – If the incident was traumatizing enough or you were injured permanently, your ability to enjoy normal life activities may be diminished

Punitive Damages

In cases involving gross negligence or intentional misconduct, a judge or jury may award punitive damages to the injured party to punish the defendant further.

Dog bite infections are one of the most serious risks after a dog attack. Beyond the pain of dog bites, even a small wound can lead to a nasty infection if left untreated.
At Dog Bite Injury Lawyer, we help victims get the urgent medical care they need and hold negligent dog owners accountable. Wash the wound with warm water, use a clean cloth and sterile bandage, and seek help from a healthcare professional right away to prevent infection and protect your legal rights.

Common Signs Your Dog Bite Wounds Are Infected

If dog bites are not promptly treated, they can develop a severe infection. Seek immediate medical attention from a doctor if you notice any of these warning signs:

Increasing redness or swelling around the wounds

Warmth or heat radiating from the area of the injury

Severe pain or tenderness that worsens over time

Pus or cloudy drainage coming from the wound

Fever, chills, or flu-like symptoms indicating systemic infection

Swollen lymph nodes near the site of the bite

Difficulty moving the affected area or numbness/tingling

Persistent or worsening odor from the wound

Delayed healing or skin discoloration around the injury

These signs of infection can point to dangerous conditions such as rabies, MRSA, or sepsis. Always wash the affected area gently, cover it with a clean bandage, and seek advice from a doctor immediately to prevent infection.

Serious Infections That Can Result From Bite Wounds

A dog’s mouth carries dozens of species of bacteria and viruses. When a dog bite breaks the skin, these microorganisms can enter the bloodstream, creating a high risk of infection.

Even a seemingly small dog bite can lead to a potentially deadly infection if left untreated, which is why it’s critical to see a doctor right away.

Below are some of the most dangerous infections linked to dog bites:

Rabies: A deadly viral disease spread through saliva. Rabies infection attacks the nervous system and is almost always fatal once symptoms appear, making urgent medical attention and vaccination essential after a suspected exposure.

Tetanus (Lockjaw): A toxin-producing bacterium that can enter through deep wounds and cause severe muscle stiffness, spasms, and potentially life-threatening complications.

Staph and Strep Infections (Including MRSA): Common bacteria on dogs’ skin and in their mouths. When transferred to humans, they can cause skin abscesses, cellulitis, or systemic infections requiring strong antibiotics.

Pasteurella: A type of bacteria frequently found in animal bites, causing pain, swelling, and potentially serious joint or bone infections if untreated.

Capnocytophaga: Bacteria present in the mouths of dogs that can cause bloodstream infections, sepsis, and meningitis, especially in people with weakened immune systems.

These pathogens make it clear why cleaning the wound and promptly consulting a doctor are so important to prevent infection and protect your health.

How to Protect Your Health and Legal Rights After a Bite

Taking quick action after a dog attack can protect both your health and your right to compensation. Follow these essential steps to reduce the risk of infection and strengthen your potential legal claim:

Seek Medical Attention

Wash the wound area gently with warm water and a clean cloth, apply a sterile bandage, and visit a doctor immediately. Prompt care helps prevent infection, ensures proper wound cleaning, and provides needed antibiotics or vaccines such as rabies or tetanus.

Document Your Injuries

Take clear photos of the wounds, any signs of infection, and your medical records. This evidence can be crucial if you pursue a legal claim for dog bites.

Preserve Evidence

Save torn clothing, keep receipts for medical care, and gather contact information from people who witnessed the dog harming you.

Consult an Experienced Attorney

Contact us to learn your rights under Illinois law and to pursue compensation for your injuries.

When to Call Animal Control

You should report the incident to your local Illinois animal control agency as soon as possible. Filing an official report:

Creates a record of the dog and its owner, which supports your legal claim.

Ensures public safety by checking the dog for rabies or prior attacks.

Helps prevent future attacks by prompting authorities to investigate and take action if necessary.

Holding Owners Accountable for Infected Bite Injuries in Illinois

When a dog bite leads to an infection, victims often face mounting medical bills, lost wages, and painful recovery.

Under Illinois law, a dog’s owner is strictly liable for all damages their animal causes, meaning you do not have to prove negligence to recover compensation. This includes the high cost of treating a complicated infection from a dog bite, as well as the long-term impact of the injuries.

Compensation under Illinois law can cover:

Medical expenses for hospitalization, antibiotics, vaccinations, and follow-up care to treat infected wounds

Lost wages during recovery or time away from work due to infection-related complications

Pain, suffering, and emotional distress caused by the dog attack and prolonged healing process

Permanent scarring or disability, especially if the wounds or infection leave lasting damage

The Full Spectrum of Harm Caused by a Dog Attack

Dog attacks can be unpredictable. Although many Illinois dog owners train their pets well, they are still animals that can struggle to maintain impulse control in certain situations. When dogs bite people or knock them over as they attempt to escape, the victims can suffer from significant injuries. Some wounds are physical, but a dog attack can also cause psychological trauma that takes years to overcome.

Whether a dog bites you or causes you to trip on a sidewalk when trying to get away, understanding the full scope of your injuries is essential if you are considering legal action against the owner. In Illinois, owners are generally responsible for the behavior of their dogs, so they may be liable for the injuries you suffered in the attack.

A dog bite injury lawyer can guide you through the legal process to pursue fair compensation for legal damages caused by your dog attack injuries. Let’s discuss some of the most common dog bite injuries that can affect the outcome of your claim.

Immediate and Visible Dog Bite Injuries

When a dog bites a person, they may experience immediate and visible injuries that can pose significant health risks. A cut could become infected, or the dog could pass certain diseases through their saliva. Let’s look at some of the most obvious physical injuries that could increase a potential settlement in a dog bite case.

Puncture Wounds and Lacerations

Victims of dog bites frequently deal with puncture wounds. When the dog’s teeth break through the skin, it can expose the inner layers of the skin, tissue, and even bone. The stronger the bite, the deeper the puncture wound may be. Dog bites also lead to lacerations, which refer to the tearing of the skin. A deep laceration may occur if the dog is able to tear at the victim’s skin after biting them.

Scarring and Permanent Disfigurement

Dog attacks can cause severe injuries that show up immediately, and some may lead to permanent scarring or disfigurement. For example, if a large breed (such as a pit bull) manages to bite and tear away some of the flesh, that part of the body may never heal fully, resulting in a visible scar or disfigurement. The more severe the attack, the more likely the victim is to suffer from permanent alterations to their appearance.

Severe bite wounds that cause facial injuries often cause permanent disfigurement because of the challenges associated with facial reconstructive surgeries.

Severe Physical Injuries from Vicious Dog Attacks

While puncture wounds and lacerations may be treated effectively, some types of serious injuries are more likely to alter your lifestyle or cause a drawn-out recovery process. Such injuries may cause lasting effects that increase the legal damages you suffer after the incident. Let’s examine some of the physical injuries that could alter the course of your life.

Nerve, Muscle, and Tendon Damage

Dog bites can be powerful enough to penetrate the deeper layers of the body, including the nerves, muscles, and tendons. However, if a dog latches onto your arm or ankle during the attack and throws their head violently from side to side, the motion could also cause damage to these body parts. These types of injuries can be extremely painful, which can contribute to greater economic and non-economic damages for your case.

Broken Bones and Crush Injuries

Broken bones are commonly associated with serious dog bites. If the animal is able to clamp their jaw and get a grip on part of your body, fast movements could result in broken bones. Additionally, a dog attack could cause you to flee the scene quickly, potentially leading to a fall that results in broken bones. In either case, a broken bone can have a major impact on your lifestyle, especially if the fracture is serious enough to require months of stabilization and treatment.

Many of these injuries will require medical attention, and this can affect how much compensation you are eligible for in your claim. Document everything related to your injuries when possible, including photos, test results, physical therapy bills, and medical professional testimony.

The High Risk of Infection from Any Bite Wound

One of the major concerns following a dog bite is the risk of infection. At any given time, there is a high volume of bacteria in a dog’s mouth. When they bite a person, they can transmit this bacteria to the victim through their teeth and saliva. These bacteria, such as Pasteurella, can cause dangerous health conditions, including Tetanus and Rabies.

In some cases, dogs that are not up to date with their vaccinations may pose a risk of transmitting Rabies to the bite victim. Infections, if left untreated, can lead to serious health complications, even death. Unlike common injuries like bite wounds and minor fractures, an infection may require a more complex treatment plan.

Lasting Psychological Trauma

Although the physical injuries from a dog bite can be damaging enough, the mental and emotional harm that is inflicted on the victim can also impact their life moving forward. Many victims of dog bite attacks experience emotional challenges, including Post-Traumatic Stress Disorder, anxiety, depression, and even a lifelong phobia of dogs. This can be especially traumatizing for someone who is already a dog owner themselves.

In the Most Tragic Dog Bite Cases: Fatal Dog Attacks

Though most victims will survive a dog bite attack, these incidents can lead to the death of the victim. Unfortunately, a fatal dog bite attack often affects children. The dog attack may be considered fatal if the victim dies during the attack or after succumbing to injuries sustained in the attack.

If the victim of a dog bite attack dies, their family members could pursue compensation in a wrongful death claim. This is a type of civil legal action that allows surviving family members, such as spouses or children, to recover damages caused by the loss of their loved one.

Acknowledge that some attacks are so severe that they result in the victim’s death. Briefly explain that in these tragic situations, the victim’s surviving family members have the right to file a wrongful death claim.

Your Right to Compensation for Dog Bite Injuries

According to the Illinois Animal Control Act, dog owners have strict liability if their pets bite or otherwise attack innocent victims. The only exceptions to liability are when the victim was provoking the dog or trespassing on someone else’s property during the attack.

In most other circumstances, the dog’s owner (or caretaker at the time of the attack) can be held liable for the legal damages you suffered in the attack. When dog bites occur, they often cause physical, emotional, and financial consequences for the victims. With a successful lawsuit, you can recover a fair settlement to address your losses from the dog bite attack.

Let’s explore the most common legal damages cited in dog bite attack claims:

Economic Damages

Economic losses are typically associated with specific amounts, making them easier to calculate with the help of an attorney. The following damages may affect the settlement if you win your claim:

Lost wages – Dog bite injuries, or damage caused by a dog attack, may be serious enough to force you to miss work during your recovery, which will make you eligible for lost income

Lost earning capacity – If the dog bite attack causes permanent damage that prevents you from finding gainful employment, you could seek additional compensation for diminished earning potential

Medical expenses – If you had to seek medical attention of any kind due to your injuries, you can claim these costs in the settlement (emergency care, surgery, future medical care, medication, pain management, rehabilitation, and therapy)

Property damage – Although this legal damage is rare in dog bites, the animal could damage personal possessions, such as a car, which can be included in your claim

Non-Economic Damages

These losses are more open-ended in civil lawsuits. They typically relate to the long-term impact of the dog bite attack, especially as it relates to your emotional state. Here are some common non-economic damages in dog attacks:

Emotional trauma – The psychological effects of a dog bite can be devastating and last for years, causing PTSD, anxiety, depression, a fear of dogs, and even self-harm

Pain and suffering – A bite wound or slip and fall accident can cause physical injuries that lead to ongoing pain for the victim, which can be assessed as a non-economic loss.

Disability and disfigurement – The impact of a dog attack may cause disfigurement or scarring, which can elevate the suffering of the victim due to the effect on their happiness

Loss of enjoyment of life – Traumatic events and painful injuries can prevent you from experiencing happiness in normal life activities, greatly diminishing the quality of your lif.e

Wrongful Death Damages

In cases where the victim dies during the attack or from their injuries, the surviving family members can pursue the following damages in a lawsuit:

Funeral and burial costs – The settlement may cover expenses related to laying the deceased to rest

Loss of companionship – Close family members, such as siblings, spouses, children, and parents, can claim compensation for losing a loved one due to negligence

Loss of financial support – If the victim of the dog bite attack earned an income, their financial dependents can seek compensation for lost income

Punitive Damages

A judge or jury may award these losses in a case involving gross negligence or intentional misconduct. For example, if the dog owner purposely kept their dog off a leash when out for a walk and the animal attacked you, this could be a case of intentional misconduct.

Most people think of bites when they picture a dog attack, but non-bite dog attack injuries can be just as devastating. In Illinois, victims who are attacked by a dog, even without being bitten, may suffer severe injuries such as broken bones, deep scratches, and lasting emotional trauma.

Fortunately, under the Illinois Animal Control Act, dog owners can be held liable for all injuries caused, giving victims the right to seek compensation for their losses.

Common Non-Bite Injuries from a Dog Attack

A serious dog attack does not need to involve a bite to cause significant harm. Non-bite dog attack injuries are surprisingly common and can be just as life-changing as bite wounds. Dog owners are responsible for all injuries caused by their animals under Illinois law, including these frequent injuries:

Fall-Related Injuries – Being knocked to the ground by a lunging or charging dog can result in bone fractures, sprains, dislocated joints, or head trauma such as concussions. Older victims may even suffer heart attacks triggered by the stress of being attacked by a dog.

Scratches and Lacerations – A dog’s claws can inflict deep, scratching wounds, sometimes more damaging than a bite. These cuts may lead to scarring, nerve damage, or dangerous infections requiring medical treatment.

Psychological Trauma – The terror of being attacked by a dog can cause emotional distress, severe anxiety, and post-traumatic stress disorder (PTSD), especially in children.

These types of injuries often lead to substantial medical bills and long-term therapy, which is why Illinois law allows victims to pursue a dog attack lawsuit for fair compensation.

Why Illinois Law Covers More Than Just Dog Bites

Illinois has one of the strongest dog liability laws in the country. Under the Illinois Animal Control Act (510 ILCS 5/), dog owners are held liable if their animal “attacks, attempts to attack, or otherwise injures” a person who is lawfully in a public or private place.

That key phrase “otherwise injures” makes it clear that a physical bite is not required to file a dog attack lawsuit. If a dog knocks someone down, causes fractures, inflicts deep scratches, triggers emotional trauma, or otherwise harms a victim without biting, the owner can still be responsible.

This broad protection reflects the reality of dog attack incidents: injuries such as falls, dog scratching, or mental health treatment needs can cause just as much suffering as a traditional bite wound. Under Illinois’s strict liability framework, victims can recover compensation for all damages they’ve suffered, including medical expenses, lost wages, and non-economic damages like pain and suffering.

When Are Dog Owners Not Held Liable in Illinois

Even though Illinois imposes strict liability for dog attack cases, there are two primary exceptions where a dog owner may not be held liable for injuries inflicted by their animal:

Provocation – If the victim was intentionally tormenting, teasing, or provoking the dog at the time of the attack, the owner may not be responsible for the resulting injuries.

Trespassing – If the victim was unlawfully on the owner’s private property when the dog attack occurred, the owner may be exempt from liability.

These exceptions highlight why it’s essential for dog attack survivors to understand their legal options and consult an attorney. Even when provocation or trespassing is alleged, an experienced lawyer can evaluate the facts and help the victim pursue fair compensation for their suffering.

Seeking Compensation in Non-Bite Dog Attack Cases

Victims of non-bite dog attack injuries in Illinois have the same right to get compensation as those harmed by bites. Under the Illinois Animal Control Act’s strict liability standard, a personal injury claim can recover both economic and non-economic damages suffered in a dog attack.

Economic Damages

These are the measurable financial losses you’ve suffered because of the dog attack:

Medical Bills – Emergency care, hospital stays, surgeries for bone fractures, wound care for scratching, and psychological therapy for emotional distress or PTSD.

Lost Wages – Income lost while you recover from being attacked by a dog, plus future earning capacity if your ability to work is reduced.

Property Damage – Reimbursement for clothing items, glasses, phones, or other belongings destroyed during the attack.

Non-Economic Damages

These compensate you for the harder-to-quantify impact of the dog attack:

Pain and Suffering – Compensation for ongoing physical pain, mental anguish, and emotional ramifications caused by the attack.

Loss of Enjoyment of Life – The impact of your injuries on your daily activities, hobbies, and relationships.

Psychological Treatment – Recovery for the emotional toll, including therapy costs for PTSD, anxiety, and fear of dogs.

Most dog attack recoveries, including those involving injuries without biting, are paid through the dog owner’s homeowner’s or renter’s insurance policy. Our attorneys know how to work with insurers to ensure victims receive the resources they need for a complete recovery.

Our Settlements and Recoveries for Dog Attack Victims

At Dog Bite Injury Lawyer, we have a strong record of securing significant results for dog attack survivors across Illinois. These outcomes show that both bite and non-bite injuries can justify substantial compensation when dog owners are held liable under Illinois law. Here are a few of our notable recoveries:

$885,000 Settlement – Secured for a teenage boy who was attacked by a large dog and pushed into a bonfire at a cookout, suffering serious burns and lasting trauma.

$700,000 Settlement – Obtained for a victim who was attacked by a dog and endured severe injuries, including nerve damage and scarring.

$550,000 Settlement – Achieved on behalf of an elderly woman knocked over by a dog at an apartment building, causing multiple leg fractures and lengthy rehabilitation.

Every dog attack court case is unique, but the settlements above highlight how our lawyers fight to maximize compensation for every victim. Whether your injuries came from a bite, scratching, or being knocked to the ground, our team has the experience to build a strong dog attack lawsuit, negotiate aggressively with insurers, and help you get compensation for all of your damages.

Why You Must Seek Medical Attention After Any Attack

After any dog attack, including one without bite injuries, it’s critical to seek medical attention right away. Many dog attack victims underestimate their injuries because there’s no visible bite, but serious harm can still occur.

Hidden Injuries – Falls or being knocked over can lead to bone fractures, internal bleeding, or a concussion that may not show symptoms immediately. A prompt medical exam helps diagnose these conditions early.

Infection Prevention – Even small scratches or cuts can become infected if untreated. Early care can reduce complications.

Medical Documentation – Visiting a doctor creates an official medical record linking your injuries to the attack, which is crucial when filing a dog attack lawsuit.

Seeing a doctor also supports your psychological treatment, ensures that non-economic damages like emotional traumatic disorders are documented, and gives you the best chance at a complete recovery. Prompt medical treatment strengthens your ability to recover compensation and hold the dog owner liable under Illinois’s Animal Control Act.
